RELEASE OF LIABILITY, ASSUMPTION OF RISK & AGREEMENT

In consideration of being allowed to participate in any activities organized by San Francisco Dodgeball LLC (“SF Dodgeball”), including but not limited to leagues, open gyms, pickup games, tournaments, practices, and related events (collectively, the “Activities”), I agree as follows:


1. ASSUMPTION OF RISK

I understand that participation in dodgeball and related Activities involves inherent and significant risks, including but not limited to:

  • Being struck by dodgeballs

  • Collisions with other participants

  • Slipping or falling on gym floors

  • Impact with walls, bleachers, or equipment

  • Finger, hand, facial, or eye injuries

  • Concussions and traumatic brain injuries

  • Sprains, fractures, paralysis, or death

  • Exposure to communicable illnesses

I acknowledge that these risks may arise from the actions or negligence of myself or others, the condition of the facilities, equipment, or the manner in which the Activities are organized or supervised.


I KNOWINGLY AND VOLUNTARILY ASSUME ALL RISKS, BOTH KNOWN AND UNKNOWN, INCLUDING RISKS ARISING FROM THE ORDINARY NEGLIGENCE OF SF DODGEBALL OR ITS OWNERS, OFFICERS, EMPLOYEES, AGENTS, VOLUNTEERS, SPONSORS, FACILITY OWNERS, AND OTHER PARTICIPANTS (“RELEASED PARTIES”).


2. RELEASE OF LIABILITY

To the fullest extent permitted by California law, I, on behalf of myself and my heirs, assigns, personal representatives, and next of kin, hereby:

RELEASE, WAIVE, AND DISCHARGE THE RELEASED PARTIES FROM ANY AND ALL CLAIMS, DEMANDS, CAUSES OF ACTION, OR LIABILITY FOR ANY INJURY, ILLNESS, DISABILITY, DEATH, OR PROPERTY DAMAGE ARISING OUT OF OR RELATED TO MY PARTICIPATION IN THE ACTIVITIES, INCLUDING CLAIMS ARISING FROM THE ORDINARY NEGLIGENCE OF THE RELEASED PARTIES.

This release does not apply to gross negligence, reckless misconduct, or intentional wrongdoing.


3. CALIFORNIA CIVIL CODE §1542 WAIVER

I understand that I am releasing known and unknown claims.

I expressly waive the protections of California Civil Code Section 1542, which states:

“A general release does not extend to claims which the creditor does not know or suspect to exist in his or her favor at the time of executing the release, which if known by him or her would have materially affected his or her settlement with the debtor.”

I understand and agree that this waiver is an essential term of this Agreement.


4. AGREEMENT TO FOLLOW RULES

I agree to comply with all rules, policies, and instructions of SF Dodgeball. If I observe any unsafe condition, I will immediately remove myself from participation and notify an official.


5. INDEMNIFICATION

I agree to defend, indemnify, and hold harmless the Released Parties from any claims, demands, or actions brought by me or on my behalf arising out of my participation in the Activities.


6. MEDICAL AUTHORIZATION & COSTS

I authorize SF Dodgeball to obtain emergency medical treatment for me if necessary. I understand and agree that I am solely responsible for any medical expenses incurred.

I understand that SF Dodgeball does not provide medical or health insurance coverage for participants.


7. DISPUTE RESOLUTION

Any dispute arising out of or relating to this Agreement or my participation in the Activities shall be resolved by binding arbitration in San Francisco County, California, under California law. I understand that by agreeing to arbitration, I am waiving the right to a jury trial.


8. SEVERABILITY

If any provision of this Agreement is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.


9. TERM

This Agreement applies to all participation in SF Dodgeball Activities during the 2026 calendar year.


10. PHOTO & MEDIA RELEASE

I grant SF Dodgeball permission to use photographs and/or videos of me taken during the Activities for promotional, marketing, advertising, or educational purposes in any media format.

I waive any right to compensation and release the Released Parties from any claims arising from such use.


11. ACKNOWLEDGMENT

I certify that:

  • I am at least 18 years of age.

  • I have carefully read this Agreement.

  • I understand that I am giving up substantial legal rights, including the right to sue for ordinary negligence.

  • I agree to this Agreement voluntarily and without inducement.

  • My electronic signature is legally binding under California law.

Code of Conduct

I acknowledge that I have received access to and reviewed the SF Dodgeball Code of Conduct and Policies (the “Policies”). I agree to comply with all Policies during my participation in any SF Dodgeball activities, including leagues, open gyms, tournaments, and related events.

I understand and agree that SF Dodgeball reserves the right, in its sole discretion, to suspend or remove any participant whose conduct is deemed unsafe, disruptive, unsportsmanlike, or otherwise inconsistent with the Policies or the spirit of the league.

I acknowledge that removal or suspension may occur without prior warning and that no refunds will be issued in the event of suspension, dismissal, voluntary withdrawal, or violation of the Policies.

I understand that SF Dodgeball may update or modify its Policies from time to time, and I agree to remain bound by the most current version.

SF Dodgeball is committed to cultivating a safe, enjoyable, and inclusive environment for all participants, regardless of gender identity, sexual orientation, race, religion, disability, age, or any other characteristic protected under applicable law.

Discrimination, harassment, or prejudicial conduct — including but not limited to racism, sexism, transphobia, homophobia, or other forms of targeted hostility — is prohibited.

SF Dodgeball reserves the right, in its sole discretion, to suspend or remove any participant whose conduct is determined to violate this commitment or undermine the safety and inclusivity of the league.


Discrimination in the form of bigotry, racism, sexism, transphobia, homophobia, and other forms of prejudice behavior are strictly prohibited and will result in immediate dismissal from all SF Dodgeball events.

Guest and Minor Policy

SF Dodgeball activities are intended for registered adult participants (18+) only.


Participants may not bring guests or minors onto the playing area or into restricted areas without prior approval from SF Dodgeball.

Any approved guest present at an event must sign a valid Release of Liability prior to participating in any activities. Guests who do not sign a release are permitted only as spectators and may not participate in gameplay.


Participants who bring a guest or minor onto the premises are solely responsible for their supervision, conduct, and safety at all times.

To the fullest extent permitted by law, the participant agrees to indemnify and hold harmless SF Dodgeball from any claims, damages, or liabilities arising out of the presence or conduct of any guest or minor brought by the participant.


SF Dodgeball reserves the right to deny entry to or remove any guest or minor at its sole discretion.

Concussion Awareness Policy

Overview

Player safety is a top priority. Concussions are serious injuries that can occur in any sport, including dodgeball. Recognizing the signs of a concussion and responding quickly helps protect players from more serious health risks.


What is a Concussion?

A concussion is a type of traumatic brain injury caused by a blow or jolt to the head or body that causes the brain to move rapidly inside the skull.

A concussion can occur even without losing consciousness, and what may seem like a minor hit can still be serious.


Possible Signs and Symptoms

Players experiencing a concussion may report or display:

  • Headache or pressure in the head

  • Nausea or vomiting

  • Dizziness or balance problems

  • Blurry or double vision

  • Sensitivity to light or noise

  • Feeling foggy, sluggish, or groggy

  • Difficulty concentrating or remembering

  • Confusion

  • Feeling “not right” or unusually emotional

Symptoms may appear immediately or several hours after the injury.


What Happens if a Concussion is Suspected

If a player is suspected of having a concussion:

  1. Immediate Removal from Play

The player will be removed from the game or activity immediately.

  1. Medical Evaluation Recommended

The player should seek evaluation from a qualified healthcare professional as soon as possible.

  1. Notify League Staff

The incident should be reported to the league organizer or manager.

  1. No Same-Day Return

A player removed due to a suspected concussion will not return to play that day.


Return to Play

A player diagnosed with a concussion may return to league activities only after providing written medical clearance from a licensed healthcare professional.


Players should not return to play until they are symptom-free and medically cleared.
